This article is devoted to the disclosure of questions regarding expediency introducing into national legislation a provision on insurance civil liability lawyer, in particular, through prism voluntariness or obligation establish it.
 Within scope this article, different approaches domestic and foreign scientists advantages disadvantages lawyer's institute were investigated. The points view legislators countries necessity voluntary mandatory nature its consolidation are also analyzed.
